Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. Food democracy is a concept with growing influence in food research. Food democracy deals with how actors may regain democratic control over the food system enabling its sustainable transformation. Following multi-level perspective framework's connotations, food democracy research has so far mainly focused on the niche level of the food system. An integrative approach that includes the perspectives of both the regime and the niche is still missing. This study addresses this research gap and proposes a new conceptual framework for food (...) democracy that includes actors from the niche and the regime level. Furthermore, we apply our conceptual framework to the urban food system of Vienna to explore the deeper meaning and practice of food democracy. Finally, we have conducted semi-structured interviews with actors at niche level and regime level within Vienna’s urban food system. Findings from this research broaden the perspective on food democracy and illustrate actors’ contributions at niche and regime level such as promoting organic food, re-localizing food provision, and procuring environmentally sustainable public food. Barriers to food democracy were also identified, e.g.: actors’ self-enhancement values, market-orientation, and capitalist alignment or lack of transparency. We conclude that actors at the niche and, to some extent, at the regime level may contribute to a process of on-going changes that fosters a transformation of established structures within the food system. There are many ways of interpreting the so-called new technologies. One of the most interesting is that which stems from defining them as a social imaginary, and therefore, as collective beliefs, fears and hopes. It is common to attribute to technologies all manner of threats that, founded or not, are real in the measure that the society makes decisions and acts in a way consistent with this conviction.The fears and anxieties of society lead to a consideration of the limits of (...) the human that technologies transgress. Among the figures with which one speaks about these limits there is Frankenstein, the modern Prometheus, which threatens modern fantasies with its deformity. There is, however, another man-made creature that can serve to orient our reflection, the Golem.In 1609, 400 years ago, Rabbi Loew died. He is credited with the creation of a homunculus by combining of secret codes. The problem of the Golem was its imperfect soul made manifest in its lack of speech. Its silent presence was a source of great fear in the community that finally asked to get rid of the creature.These figures of monstrosity, Frankenstein and above all Golem, will help us to make technologies understand from the fear that society projects onto them, and this will lead us to the question concerning the imaginary fears of the technological system. Despite journalism’s commitment to ethical principles such as accuracy, humanity and diversity, compliance with the gender perspective in content is still minimal in approximately one hundred countries. This inequality reinforces misperceptions, imbalances, and perceived differences between men and women. To address this situation, from 2010 to 2021, eight Spanish media companies appointed a new editorial position responsible for self-regulating gender equality. This qualitative study focused on 10 journalists who currently exercise or have exercised that job, to detect, describe and propose (...) the implementation of this new professional role. This study suggests that gender editing has advanced equality in parity of sourcing and the presence of women in the opinion sections, but implementation of equality in overall content is more difficult. Gender editors’ daily work is hampered by a lack of management support and an absence of independence in editorial decisions. (shrink)

Traditionally, the manufacturer/operator of a machine is held (morally and legally) responsible for the consequences of its operation. Autonomous, learning machines, based on neural networks, genetic algorithms and agent architectures, create a new situation, where the manufacturer/operator of the machine is in principle not capable of predicting the future machine behaviour any more, and thus cannot be held morally responsible or liable for it. The society must decide between not using this kind of machine any more (which is not a (...) realistic option), or facing a responsibility gap, which cannot be bridged by traditional concepts of responsibility ascription. Resumen El objetivo principal del presente trabajo es analizar la atenuación en los actos asertivos en entrevistas sociolingüísticas a fin de entender cómo se construye la imagen de afiliación en la cultura mexicana. En este trabajo la imagen de afiliación se define como el deseo de ser aceptado por un grupo. Nos interesa determinar si la realización de estos actos asertivos son amenazas eventuales a la imagen social de los informantes y si tienen una función atenuadora. El corpus que se (...) analizó consistió en segmentos seleccionados de 12 entrevistas, 6 de hombres y 6 de mujeres, del corpus oral “El habla de Monterrey–PRESEEA” correspondientes a informantes entre 35 y 54 años que concluyeron sus estudios de licenciatura. El análisis de este corpus oral muestra aspectos importantes, a saber, nos presenta que existen similitudes y diferencias entre los dos grupos pues tanto hombres como mujeres utilizaron la justificación para atenuar su punto de vista. En cuanto a diferencias, las mujeres emplearon más estrategias de atenuación que los hombres. Por otra parte, el análisis de los datos sugiere que la atenuación, como categoría pragmática, contribuye a caracterizar la imagen de afiliación de nuestros informantes. (shrink)

Neural devices have the capacity to enable users to regain abilities lost due to disease or injury – for instance, a deep brain stimulator (DBS) that allows a person with Parkinson’s disease to regain the ability to fluently perform movements or a Brain Computer Interface (BCI) that enables a person with spinal cord injury to control a robotic arm. While users recognize and appreciate the technologies’ capacity to maintain or restore their capabilities, the neuroethics literature is replete with examples of (...) concerns expressed about agentive capacities: A perceived lack of control over the movement of a robotic arm might result in an altered sense of feeling responsible for that movement. Clinicians or researchers being able to record and access detailed information of a person’s brain might raise privacy concerns. A disconnect between previous, current, and future understandings of the self might result in a sense of alienation. The ability to receive and interpret sensory feedback might change whether someone trusts the implanted device or themselves. Inquiries into the nature of these concerns and how to mitigate them has produced scholarship that often emphasizes one issue – responsibility, privacy, authenticity, or trust – selectively. However, we believe that examining these ethical dimensions separately fails to capture a key aspect of the experience of living with a neural device. In exploring their interrelations, we argue that their mutual significance for neuroethical research can be adequately captured if they are described under a unified heading of agency. On these grounds, we propose an “Agency Map” which brings together the diverse neuroethical dimensions and their interrelations into a comprehensive framework. With this, we offer a theoretically-grounded approach to understanding how these various dimensions are interwoven in an individual’s experience of agency. (shrink)

This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. La libertad es una de las realizaciones humanas que más se valoran, pero que a la vez es más fácil de perder, la gran mayoría de las veces de forma voluntaria. Los lamentos más usuales son: hemos perdido la libertad, o nuestra libertad está en peligro; pocas veces se dice: hemos entregado la libertad, o, sólo sabemos vivir encadenados. Pero además, se asume la libertad como algo dado, sin más, y no se toma en cuenta que es un estado o (...) condición que hay que preservar, si se tiene, y luchar por incrementarlo. De hecho, la vida es una lucha constante por aumentar la libertad. Otros aspectos incorporados a este ensayo son la fundamentación del sistema de libertades en la libertad individual –siguiendo muy de cerca a Mill-, las características de ese sistema de libertades y el cuestionamiento a las doctrina del “interés nacional” o del “interés general”, como formas veladas de colectivismo, muy estimadas en América Latina. The article analyzes the process of modification of Japan’s foreign policy after Donald Trump’s election as US president. As short- and middle-range aims of Japan’s diplomatic strategy were outlined with expectation of victory of Hillary Clinton, Tokyo was forced to abruptly change its policy. Relying on the neoclassical realist theory, the article examines the complex interaction between the external factors, such as security threats from North Korea or China, and domestic factors both in Japan and the US, that is personal, (...) institutional, societal and economic determinants. It is argued that while it was strategic convergence between Tokyo and Washington that enabled relatively smooth cooperation between Prime Minister Abe and President Trump, internal factors, such as right-wing credentials of both decision makers, distorted and to some extent facilitated this process. ¿Existe algún vínculo o nexo entre el pensamiento de Schelling y Schopenhauer? Comúnmente, la relación entre estos pensadores no ha sido estudiada debido, en gran parte, al rechazo explícito de parte de Schopenhauer a toda la filosofía postkantiana. Sin embargo, este trabajo tiene por finalidad mostrar que las ideas de uno y otro pensador, referentes al tema de la metafísica de la voluntad, tienen más de alguna coincidencia que no resulta ser meramente casual. In this evolutionary narrative, our propensity for violence was overcome in our lineage by an increase in our intellectual capacities. However, I will argue in this article that we are at least equally justified in believing that our early hominin ancestors were less aggressive and hierarchical than is suggested in these models. According to grounding necessitarianism if some facts ground another fact, then the obtaining of the former necessitates the latter. Proponents of grounding contingentism argue against this claim, stating that it is possible for the former facts to obtain without necessitating the latter. In this article I discuss a recent argument from restricted accidental generalisations provided by contingentists that advances such possibility. I argue that grounding necessitarianism can be defended against it. To achieve this aim, I postulate a relationship between grounding (...) and essence by introducing a notion of individual essences understood as a set of essential properties that individuate its bearer. According to a proposed view grounding holds in virtue of identities of its relata, which are in turn determined by their respective individual essences. From there I claim that if grounding holds in virtue of the individual essences of its relata, then it is possible to resist the objection from restricted accidental generalisations and maintain a view that grounds necessitates what is grounded. Since its original identification as a component of the heterogeneous nuclear ribonucleoprotein (hnRNP) complex, K protein has been found not only in the nucleus but also in the cytoplasm and mitochondria and is implicated in chromatin remodeling, transcription, splicing and translation processes. K protein contains multiple modules that, on one hand, bind kinases while, on the other hand, recruit chromatin, transcription, splicing and translation factors. Moreover, the K‐ protein‐mediated interactions are regulated by signaling cascades. These observations are consistent with K (...) protein acting as a docking platform to integrate signaling cascades by facilitating cross‐talk between kinases and factors that mediate nucleic‐acid‐directed processes. Comparison of K across species reveals that it is an essential factor in metazoans, but not in yeast. Although some of the K protein interactions and functions are conserved in eukaryotes from yeast to man, the mammalian protein seems to play a wider role. The greater diversity of mammalian K protein interactions and function may reflect gain of novel docking sites and expansion evolutionary of gene expression networks. The origin of the idea of non-being is a fundamental issue in metaphysics. Its absence would indicate an inability to understand the principle of non-contradiction. This article will study relevant texts in Thomas Aquinas’s corpus, and will propose an interpretation about the origin of the idea of non-being. The assertion ego affirmo aliquid esse (“I affirm that something exists”) not only affirms the existence of aliquid, but also, in a secondary way, the existence of my assertion, and the existence of (...) my self. The double object of this assertion (“something exists” and “I am”) constitutes the first intellectual difference, which is precisely the origin of the idea of non-being. (shrink)

This paper is an outline of some ways that lead us to think about the necessity of memory, inherent to the experience of the present. We will work around three thematic lines within the field of philosophy of history: first, the relation between the past and our present; second, the problem of the personal disposition of the subject of historical knowledge and his inevitable belonging to the present at the level of action; and the sense of a possible historical experience (...) where the individual and the collective intersect each other, in relation to the question of establishing whether it is appropriate to make an exhaustive remembrance of those who died because of the armed conflict in Colombia. With this purpose, we will point out to a series of elements drawn from Benjamin’s philosophy of memory so as to rehearse some possible connections with the philosophies of forgetfulness, remembrance and memory proposed by Nietzsche and Bergson. Thus, we seek to establish the reality of the past that is based on the virtual existence of recollection and, from there, to determine the ability of the latter to be updated in the form of vital forces, committed to making a future. Wittgenstein’s and Heidegger’s objections against the possibility of a science of aesthetics were influential on different sides of the analytic/continental divide. Heidegger’s anti-scientism leads him to an alētheic view of artworks which precedes and exceeds any possible aesthetic reduction. Wittgenstein also rejects the relevance of causal explanations, psychological or physiological, to aesthetic questions. The main aim of this paper is to compare Heidegger with Wittgenstein, showing that: there are significant parallels to be drawn between Wittgenstein’s and Heidegger’s anti-scientism about aesthetics, (...) and that their anti-scientism leads both towards partly divergent criticisms of what I will call ‘aestheticism’. The divergence is mainly due to a broader metaphilosophical disagreement concerning appeals to ordinary language. Thus situating the two philosophers’ positions facilitates a possible critical dialogue between analytic and continental approaches in aesthetics. (shrink)

Hume did not criticize Hutcheson’s moral-empirical argument in his published philosophical works, even though he forcefully denied, especially in Parts X and XI of the Dialogues Concerning Natural Religion, that we could empirically prove the moral attributes of the Deity. Yet he seemingly rejected this particular reasoning in a famous letter to Hutcheson, dated March 16, 1740. Hutcheson’s claim that our moral sense is a likely to be expected effect of divine benevolence and Hume’s critique of this claim are analyzed (...) in this essay. It is argued that the particular criticism presented by Hume in that letter is not sufficient to refute Hutcheson’s argument. It is also suggested that Hume may be right after all in rejecting Hutcheson’s inference about God’s benevolent design on other grounds, that is, our deep-rooted knowledge of the annoying conspicuousness of evil in the world. In order to arrive at a coherent understanding ofthe Dialogues as a whole (...) and perhaps also to calm the sense of bafflement which the confrontation with this enigmatical text always provokes, many Hume scholars have taken as a point of departure and clue for unravelling it either one or two of Hume's principal philosophical doctrines or a presumedly unitary view of Hume's philosophy in general. Equipped with one or both of these instruments, they proceed to dissect the arguments of the Dialogues with the intention of determining what Hume's position really is. This task also almost invariably ends by assigning the victory in the dialectical struggle and the representation of the author's 'true' opinions to the character (sometimes even more than one) in whom they are more or less able to find the purest expression ofwhat theyhave previously decided is the kernel oressence ofHume's philosophy. Franco-Ferraz has taken a very different route. For her the key point of the Dialogues lies in the fictional setting in which the theological discussion takes place. She goes on to show that the literary form of the Dialogues is intrinsically connected with its philosophical content so as to serve to elucidate the precise nature ofthe conclusion which is established at the end, in Part XII. In other words, the theatrical structure facilitates a more profound and detailed investigation ofthe problems dealing with the existence and nature of God. In fact, Hume offers no final solutions to these problems and thereby none ofthe characters ofthe Dialogues can properly be said to present the victorious point of view or the one counting with the complete authority ofthe author ofthe play: The most important aspect of this text is the interaction between the different characters' points of view, which, by being in confrontation with each other, undergo reciprocal transformations. Anche se siamo comunemente abituati a pensare alla scienza come a un qualcosa di assolutamente atemporale e indipendente da tutto, in realtà essa è profondamente influenzata dalla cultura e dalla società del tempo in cui vive. Infatti né la scienza è isolabile dalla società, né la società è isolabile dalla scienza, tanto meno come si sta configurando oggi. Per approfondire questi aspetti, esistono però due visioni antagoniste che bisogna superare: secondo la visione scolastica, retaggio del positivismo ottocentesco ancora molto diffuso (...) fra scienziati e pubblico di non esperti, la scienza è conoscenza senza soggetto conoscente. All'opposto, la visione cinica della scienza, sull'onda di talune elaborazioni della sociologia della scienza, la riduce a nient'altro che a una costruzione di soggetti che partecipano al gioco scientifico, una cultura come altre e da "mediare", e comunque una conoscenza relativa, se non frutto di una costruzione puramente soggettiva, arbitraria, ideologica. Un'analisi della costituzione sociale della scienza può, invece, mirare a un'indagine scientifica sulla scienza proprio configurando una relatività della conoscenza che supera sia l'assolutismo idealistico sia il relativismo soggettivistico.
